Defense Attorney’s Absence Causes Delay in Durban High Court Pretrial

The prominent murder case involving five individuals accused of the killings of South African rapper Kiernan “AKA” Forbes and his friend, celebrity chef Tebello “Tibz” Motsoane, has faced yet another setback.

On Thursday, the Durban High Court rescheduled the pretrial conference after it was confirmed that the assigned defence attorney, Simphiwe Mlotshwa, was out of the country.

Senior prosecutor Lawrence Gcaba requested the postponement, informing the court that Mlotshwa—who is now representing all five defendants—was presently in Eswatini and unable to attend.

Accused Make Another Court Appearance as Case Progresses Slowly

The five accused—Lindokuhle Thabani Mkhwanazi (30), Lindani Zenzele Ndimande (35), Siyanda Eddie Myeza (21), Mziwethemba Harvey Gwabeni (36), and Lindokuhle Mhlaliseni Ndimande (29)—made another brief appearance in the Durban Magistrate’s Court.

The group was arrested in February 2024 concerning the tragic shooting that led to the fatalities of Forbes and Motsoane outside Wish restaurant on Florida Road, Durban, on February 10, 2023.

This past February, the accused were presented with indictments that transferred the case to the high court, signifying the formal initiation of their murder trial.
