Judge Declines to Order DOJ Review

Roman Storm, a Tornado Cash developer, is scheduled to face trial in the United States this July; however, a federal judge has declined to mandate the U.S. Department of Justice to review its case-related documents.

In a ruling delivered on Friday, Judge Katherine Polk Failla refused to compel the DOJ to unveil any potentially beneficial materials that could aid Roman Storm’s defense.

This ruling arises as Storm and his legal team prepare for the trial set for July 2025, as reported by CoinDesk.

“I’m not going to require a further review based on the representations made that there’s no additional material of this type, and based on my views that I don’t believe the material was exculpatory,” commented the judge.

The judge’s ruling holds considerable weight, as a determination that prosecutors failed to provide all relevant information to Storm’s defense could have influenced their case during the trial.

Legally, prosecutors are required to furnish the defendant with any information that might bolster their defense. The trial for Storm is set to continue after the DOJ confirmed earlier this month its intention to pursue prosecution against the Ethereum mixer co-founder.

This development follows a memo from the government issued weeks ago, indicating that the DOJ would cease pursuing charges against crypto mixing services moving forward.

The focus will now pivot to targeting what prosecutors define as “bad actors” within the industry who misuse these services for illegal activities such as money laundering. The DOJ’s initiatives will concentrate on wrongdoers rather than the services themselves.

Charges were initially filed against Roman Storm and his fellow Tornado Cash founder, Roman Semenov, in August 2023, accusing them of operating the mixing service and laundering over $1 billion.

Earlier this February, a Dutch court granted the release of Alexey Pertsev, another Tornado Cash developer who had been detained in Amsterdam since August 2022.
